1. DEFINITIONS

1.1 Print4Less Advertising means Advertising Printing Australia Pty Ltd t/as Print4Less Advertising A.B.N. 25 153 045 759 of Unit 1, 7 Percy St, Auburn NSW 2144 its related or associated entities.

1.2 The Customer means the party placing an order for the purchase of goods or services from Print4Less Advertising .
1.3 An Order refers to an order for goods or services.

2. ACTING IN RELIANCE

2.1 The Customer warrants that the information provided by the Customer is true and correct. The Customer acknowledges that Print4Less Advertising will act in reliance on this information.

2A. APPLICATION OF TERMS AND CONDITIONS

2A.1 These Terms and Conditions (T&C) apply to each and every dealing between the parties Print4Less Advertising and the Customer, and the Customer agrees to adhere to these Terms and Conditions and will that they prevail over any other verbal, implied or written conditions, whether verbal, implied or written to the extent permitted by law.

2A.2 These T&Cs may be changed by Print4Less Advertising from time to time and the then current version of the T&Cs shall be binding upon the Customer.

3. ORDERS

3.1 Orders are subject to acceptance in accordance with these T&Cs.Orders are subject to acceptance by Print4Less Advertising in whole or in part

4. CUSTOMER’S RESPONSIBILITY

4.1 It is the Customer’s responsibility to ensure that the electronic files supplied comply with Print4Less Advertising’s file specifications requirements and that the files supplied are correct and able to be printed as soon as they are supplied.

4.2 Files supplied without bleed will be printed as they are supplied under the assumption that this is the Customer’s requirement.

4.3 It is the Customer’s responsibility to ensure that any materials supplied for printing do not breach relevant copyright legislation. Print4Less Advertising accepts no responsibility for any copyright issues.

4.4 No assumptions or judgements are made by Print4Less Advertising in relation to the correctness or acceptability of any electronic files supplied to us.

4.5 Electronic files are printed as they are supplied and there will be variations between finished printed products and the same file being printed on various proofing devices (ie. Inkjet printers and the like).

4.6 Customers must also understand that our printing process will result in colour variations between orders and exact colour matching cannot and will not be provided by Print4Less Advertising . Colour variations will occur from job to job and run to run.

4.7 Please do not order from Print4Less Advertising if you require an exact colour match or are uncertain with any aspect of your supplied electronic files. Under no circumstances will electronic files be kept by Print4Less Advertising for future use by the Customer.

4.8 Electronic files must be supplied with each and every order. It is also the Customer’s responsibility to understand the nature of the various stocks that we print on and the impact of different finishing options will have on that stock (ie cracking). Print4Less Advertising assumes that its Customers are fully aware of this impact before any orders are placed. Print4Less Advertising accepts no responsibility whatsoever for any cracking caused by folding of brochures or the like.

4.9 NO REFUNDS OR REPRINTS will be provided for any breaches of the Customer’s responsibility contained within this clause.

5. Reservation

Lowest Printing Price Guarantee applies only for

5.1 Printing is to be done on sheet fed offset printing

5.2 Printing press is within Greater Sydney Region

5.3 This guarantee is not valid for Digital or Web press

5.4 This guarantee is not valid if a printing press is having across the board special discounts.

5.5 For price beat, client got to provide written quote within valid period.

5.6 PRINT4LESS reserves the right to refuse any order at its discretion

6. New files or cancellation.

6.1 When placing an order online, it is final and the order cannot be cancelled without paying for a cancellation fee and for costs incurred to date in processing your order.

6.2 Where your order has not proceeded to computer to plate (CTP) stage, a minimum cancellation fee of $50+gst for all other products.

6.3 Where your order has proceeded to computer to plate (CTP) & plates have been made, a minimum cancellation fee of $300+GST or 50% of total invoice whichever is higher will apply for all other products.

6.4 If new files are to be re-supplied, cancellation fees as per 1.2 above will apply. You must supply amended order by email including cancellation fee.

7. Copyrights

7.1 PRINT4LESS ADVERTISING assumes no responsibility and accepts no liability for materials that are prohibited by Law. We will not review any material to make sure it is in accordance with lawful practices. We will not be charged with possession of illegal materials nor will PRINT4LESS ADVERTISING be held accountable for use of illegal material.

7.2 The customer will indemnify and hold harmless our company from any loss, expense, and damages arising from violation of copyright or trademark laws from the illegal use of images, photographs, slogans, trademarks, or graphical work supplied and approved by the customer.

8.Prepress

8.1 It is the responsibility of the customer to ensure all digital artwork submitted to us is properly prepared. We will not assume any responsibility for spelling, grammar, typos and/or other errors on approved artwork.

8.2 The order system automatically generates low resolution proof of all files uploaded with a pre-flight report. We do not send screen PDF proofs back to the customer unless requested. For individual jobs priced below $300, an extra cost of $50 per artwork will apply for screen PDF proofs requested by customer.

8.3 We will not be responsible for any mistakes in your original files. Please ensure that your files match our design specifications to avoid any disappointment. Once you have accepted the system generated proof for your order you are agreeing that the proof is correct.

8.4 Proofs of work submitted for customer approval are the customer’s responsibility to ensure all errors therein are corrected before resubmitting files to us. PRINT4LESS ADVERTISING will not accept any responsibility any errors not corrected by the customer. Customer alterations and additional proofs necessitated thereby shall be charged extra.

8.5 Whilst every care is taken in checking your files, for file related errors that may reduce the quality of your job, PRINT4LESS ADVERTISING accepts no responsibility for files that are not print ready but supplied to be printed.

8.6 PRINT4LESS ADVERTISING processes your file as supplied and does not manipulate or alter the artwork in any way, unless requested by customer at an extra cost.

9. Material supplied by customer

If PRINT4LESS ADVERTISING and the customer agree that the customer is responsible for supplying materials for the purpose of the order:

9.1 The customer must supply sufficient quantities of materials to allow for spoilage, such quantity to be specified by PRINT4LESS ADVERTISING

9.2 PRINT4LESS ADVERTISING will not normally count or check the materials and if requested by the customer to do so, may charge for counting or checking.

9.3 PRINT4LESS ADVERTISING will not be responsible for any defects in or the unsuitability of materials supplied by the customer.

9.4 Property in any materials supplied by the customer and incorporated in to the goods, passes to PRINT4LESS ADVERTISING at the time of incorporation.

10. Printing and finishing

10.1 PRINT4LESS ADVERTISING accepts no responsibility for colour variation on gang-print runs. Hard copies supplied by customers are used as a guide but not guaranteed to be colour matched.

10.2 As print runs are generally ganged up, print colours may vary print to reprint, from stock to stock and from job to job.

10.3 PRINT4LESS ADVERTISING does not colour match business cards. Colours may vary from one run to another or within the same run due to bulk running of business cards. We will not reprint for colour or shade variations. Machine varnish and cello-glazing may change the shade of the final colour.

10.4 There may be trimming variances of 1-2mm. Customer must allow bleed 3mm all round and keep texts 3mm in from trim marks.

11. Delivery

11.1 All goods are sold ex-factory and any delivery cost is incurred by the customer.

11.2 Orders received are generally ready for dispatch within 5-10 working days. On average it takes 5 days from order date to get jobs ready.

11.3 PRINT4LESS ADVERTISING will not be held liable for any losses incurred by customers as a result of jobs that are delayed for any reason either in production or on delivery.

11.4 If goods are delivered in a damaged condition, it is your responsibility to note this on the delivery docket with the courier. Any damages not signed for will not lead to reprint at our cost.

12. Collection

12.1 The customer must collect the goods from PRINT4LESS ADVERTISING premises upon being notified by PRINT4LESS ADVERTISING that the goods are ready for collection

12.2 If PRINT4LESS ADVERTISING agrees to deliver the goods the customer shall bear all freight costs and charges of such delivery

13. Responsibility to insure

13.1 PRINT4LESS ADVERTISING has no obligation to insure any property of the customer in PRINT4LESS ADVERTISING possession.

13.2 The customer must pay the cost of any insurance arranged by the printer at the request of the customer.
14. Accounts and payment

14.1 A completed cash application form and/or deposit are required for new customers prior to commencement of production.

14.2 Accounts and payment procedures stipulated on the Home Page are integral part of terms and conditions and must be complied with.

15. Non Payment

15.1 Retention of ownership Until the customer has paid all sums outstanding in relation to the goods

15.2. Title in the goods shall not pass from PRINT4LESS ADVERTISING to the customer

15.3 If the goods are in the customer’s possession, the customer shall hold the goods as trustee for PRINT4LESS ADVERTISING and must store the goods so that they are clearly identifiable as the property of PRINT4LESS ADVERTISING

15.4 PRINT4LESS ADVERTISING may call for or recover possession of the goods (for which purpose PRINT4LESS ADVERTISING employees or agents may enter the customer’s premises and take possession of the goods without liability to the customer) and the customer must deliver the goods to PRINT4LESS ADVERTISING if so directed by PRINT4LESS ADVERTISING.

15.5 The customer may in the ordinary course of the customer’s business, sell the goods to a third party but:

15.6 the proceeds of sale to the third party shall be held by the customer as trustee for PRINT4LESS ADVERTISING and the customer shall account to PRINT4LESS ADVERTISING for those sums; and

15.7. if PRINT4LESS ADVERTISING requires, the customer shall assign to PRINT4LESS ADVERTISING the customers claim against the third party and shall execute all documents necessary to effect that assignment.

16. General Lien

16.1 PRINT4LESS ADVERTISING shall, in respect of all sums owed by the customer to PRINT4LESS ADVERTISING hereunder, have a general lien on all property of the customer in PRINT4LESS ADVERTISING possession and may, after 14 days notice to the customer, sell that property and apply the proceeds (net of any sale costs) in satisfaction of all or any part of the sums owed.

16.2. In the event that any of the customer’s property held by PRINT4LESS ADVERTISING as aforesaid enjoys copyright protection in favour of the customer hereby grants to PRINT4LESS ADVERTISING a licence to exercise the rights conferred on PRINT4LESS ADVERTISING under this clause

17. Printing defects

17.1. All our printed products are print on demand i.e. they are printed to order for each individual customer. If you send us a ready to print document then we will print it as is without any alterations. We check all orders before they are dispatched, but if you find there is a fault with your order due to misprinting or damage, please return the faulty order and we will reprint it. However, if the problem is due to artwork issues, PRINT4LESS ADVERTISING will not reprint the job as it is your responsibility to supply print ready artwork.

17.2. Any queries regarding printing and finishing errors must be made within 5 working days of receipt of goods. Sample of defective product must be sent to PRINT4LESS ADVERTISING for analysing the nature of defect

18. Rejection

18.1. The customer may only reject the goods if they do not comply with the customer’s instructions.

18.2 If the customer wishes to reject the goods the customer must notify PRINT4LESS ADVERTISING of the rejection

18.3. If PRINT4LESS ADVERTISING delivered the goods to the customer’s premises -within 7 days of delivery (or such other time as is mutually agreed);

18.4. otherwise -within 7 days of notification that the goods are ready for collection (or such other time as is mutually agreed)

19. SHIPMENT

19.1 All representations by Print4Less Advertising as to the date and/or time for delivery are made in good faith, but are not guaranteed. All representations are made in good faith, in the light of conditions and circumstances that are known to Print4Less Advertising at the time.

19.2 Print4Less Advertising and its directors, officers, employees and associated companies shall not be liable for late deliveries or non-deliveries and under no circumstances shall Print4Less Advertising be liable for any loss, or damage, including consequential loss or damage, or delay occasioned suffered by to the Customer or its Customers arising from late or non-delivery of goods or service, whether such loss or damage is due to negligence or wilful act, misconduct or default of Print4Less Advertising or any third party and whether or not if the same occurs in the course of the performance by Print4Less Advertising of any contract or in circumstances which are foreseeable by Print4Less Advertising or in circumstances which would constitute a fundamental breach of any contract or a breach of any fundamental term hereof.

19.3 Goods will normally be shipped by the most convenient and economical method and route having regard to the nature of the goods. Print4Less Advertising reserves the right to charge the Customer for delivery.

19.4 If Print4Less Advertising was unable to deliver part of an order for any reason whatsoever, Print4Less Advertising may deliver by instalments. Each instalment shall be regarded as a separate contract and any defect in, or failure to deliver an instalment shall not give the Customer the right to cancel the balance of deliveries due under the order.

19.5 The Customer will upon receipt, inspect the goods and notify Print4Less Advertising of any errors or shortages within three days after delivery, quoting delivery docket numbers and all other relevant details.

20. DAMAGE OR LOSS IN TRANSIT

20.1 It shall be the responsibility of the Customer to insure the goods after despatch from the Print4Less Advertising . Print4Less Advertising may suggest or offer group insurance but it is the Customer’s responsibility to ensure that the insurance is adequate for the purpose. Print4Less Advertising shall not be liable for any loss or damage suffered during transit of the goods to the Customer.

21. Privacy & security

21.1. Our company reserves the right to contact any customer via phone, email, or post mail regarding current orders, notification of promotions and future orders.

21.2. Any customer may choose to opt out of receiving future communications from us, by simply unsubscribing from our email correspondence and/or sending a written request to our offices.

21.3. Your email and address are used in the processing and delivery of your order. We do not pass these details onto anyone else.

21.4. Spam policy our company does not send unsolicited emails. If you receive any such email which appears to originate with us, please copy the message including Headers and send to us for action.

22. MISCELLANEOUS

22.1 These T&Cs shall be governed by and interpreted in accordance with the laws of NSW and the parties irrevocably submit to the non-exclusive jurisdiction of the courts of that jurisdiction and any appeal courts from them.

22.2 The Customer acknowledges and agrees that Print4Less Advertising may assign all of its rights, benefits and interests under this Agreement to any other entity as nominated by Print4Less Advertising . Any such assignment by Print4Less Advertising shall not prejudice or affect the rights, claims or interests of the Customer or Print4Less Advertising which have accrued up to the date of assignment.

22.3 The Customer shall not assign, transfer or novate its rights and obligations under this Agreement, without the prior written consent of Print4Less Advertising , in Print4Less Advertising absolute discretion.

22.4 If any provision of these T&Cs is, for any reason, wholly or partly held to be illegal, void, invalid or unenforceable by a court of law or other competent authority, that provision shall be severed in the relevant jurisdiction and all other provisions of the T&Cs shall continue in full force and effect.

22.5 No failure to exercise, nor any delay in exercising, any right, power or remedy by Print4Less Advertising operates as a waiver. A single or partial exercise by Print4Less Advertising of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on Print4Less Advertising unless in writing. Print4Less Advertising rights, powers and remedies under these T&Cs are in addition to, and do not exclude or limit, any right, power or remedy provided by law or equity or by any other agreement or instrument.

22.6 The Customer consents to the use of any Personal Information of its employees, officers or agents, for the purposes set out in Print4Less Advertising Privacy Policy including but not limited to the Customer’s or its director’s credit history.

22.7 Print4Less Advertising shall not under any circumstances be responsible to the Customer for any failure to comply with its obligations under this Agreement pursuant to any order that is accepted, which failure is caused by an act of God, acts of any Government, war or other hostility, national or international disaster, the elements, fire, explosion, power failure, equipment failure, strikes or lockout, inability to obtain necessary supplies and the like and other force majeure occurrences.
